The Harwin Balancer (“Balancer”) has been designed and manufactured for optimum performance and durability. The Balancer is under warranty solely to the original purchaser for a period of three years after delivery of the Balancer to the purchaser. The Balancer is warranted against any defective part of the equipment, materials or workmanship.
This warranty is void if the Balancer has been damaged by accident, in shipment, unreasonable use, misuse, neglect or other causes not arising out of defects in materials or workmanship. Harwin Performance, LLC (“Harwin Performance”) will replace any defective part received within the warranty period.
This warranty extends only to the replacing of parts Harwin Performance determines to be defective. The exclusions stated above will apply to that determination. This warranty expressly disclaims any other warranties of Harwin Performance aside from the limited replacement warranty described herein.
Purchaser assumes the risk of using the Balancer. Purchaser fully accepts such responsibility and releases from liability Harwin Performance and its owners, agents and affiliates for any and all personal injuries, deaths, losses, costs and damages incurred as a result of the ownership, use or operation of the Balancer. Harwin Performance disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, non-infringement of intellectual property rights or other proprietary rights. Some pressure-treated plywood may contain toxic chemicals or carcinogens that migrate or become dislodged. Harwin Performance shall not be liable for any damages of any kind arising from the use of the Balancer. By placing an order purchaser acknowledges that they have read and understood, and agree, to the terms and conditions of this agreement, and represent that they are of legal age (age 18 or older) to enter into this agreement and become bound by its terms.
USE OF PRODUCT
The Balancer is intended to be used for rehabilitative and general conditioning purposes. Persons who suffer from balance problems, age-related frailty or are otherwise in poor physical condition should first consult with their physical therapist or health professional prior to using the Balancer.
Before use, always check the Balancer for any sign of defect. If a defect is found, or questions arise regarding the proper use of the Balancer, discontinue use and immediately contact Harwin Performance, LLC at firstname.lastname@example.org
